Councillor R Kendall declared a Significant Non-Pecuniary Interest in RP-3 ENFORCEMENT ACTION FOR DA09/0872 the reason being that he is a business associate with a Director and/or company owner of the business subject to this report and vacated the chamber during its consideration.

b       approve an exemption from the need to obtain an Approval under the Activities on Footpath Policy (POL 041) for all businesses on Baylis and Fitzmaurice Streets on the 4th, 11th and 18th of December 2020 for dining, seating, goods display, signage and decorations

 

Councillor T Koschel vacated and did not return to the meeting the time being 6:50pm.

 

An AMENDMENT was moved by Councillor V Keenan and seconded by Councillor R Kendall

 

That Council:

RP-5          CONSTITUTIONAL REFERENDUM - POPULARLY ELECTED MAYOR

A Motion was moved by Councillors D Hayes and P Funnell

That Council:

a       note the process and costs involved in the community consultation to conduct a Constitutional Referendum for a popularly elected Mayor

b       note the NSW Electoral Commission have been engaged to conduct the referendum in conjunction with the 2021 NSW Local Government Elections

c        approve the budget variation as noted in the financial implications section of this report.

c        approve Option One being the following referendum wording for the 2021 Local Government Election:

Wagga Wagga City Council currently has nine Councillors with the Mayor elected by the Councillors every two years. Do you approve to change this to the voters of Wagga Wagga electing a Mayor for a four-year period?

a       receive the minutes of the Riverina Regional Library Advisory (RRL) Committee Meeting held on 28 October 2020

b       endorse the reimbursement of 25% of 2019/20 mobile library contributions to councils that receive mobile library services in recognition of the loss of service provision during the COVID-19 shutdown

c       approve the amount of $74,599 to be transferred from the Mobile Library Reserve Fund to the 2020/21 budget for distribution to councils that receive mobile library services in the same proportions to their contributions

QUESTIONS/BUSINESS WITH NOTICE

 

Councillor D Hayes requested advice on if Council had plans to install bus shelters in the main street to offer protection to the community from weather elements.

 

Councillor V Keenan requested that staff provide a list of Code of Conduct complaint resolutions for the term of this Council, that name a Councillor. In addition provide a list of Votes of No Confidence motions including the movers and seconders during this term of Council.

 

Councillor K Pascoe acknowledged and congratulated staff for their recent works in  pruning along Hammond Avenue from Blaxland Road to Eunony Bridge Road.

 

Councillor R Kendall requested a site visit to Beauty Point to assess drainage and erosion issues in the area.

 

Councillor P Funnell stated how magnificent the City currently looks and acknowledged the outstanding efforts of staff in maintaining the City in particular the parks and gardens areas.

 

Councillor P Funnell requested advice on the process of responding to Questions/Business with Notice including the mechanism for providing advice back to Council and the community on matters raised in this session.

 

The Mayor, Councillor G Conkey OAM passed on appreciation and congratulations from the owners of the new Service Station/IGA on Hammond Avenue to Council staff for the professional manner in which their development managed by Council.

20/456       RESOLVED:

                   On the Motion of Councillors R Kendall and P Funnell

That Council:

a       accept the offer of DG Harper Pty Ltd (ABN: 47 000 762 596) for the Removal and Disposal of Underground Petroleum Storage Tanks, Supply and Installation of Above-Ground Refuelling Facility for their lump sum amount of $490,453.27 excluding GST

b       authorise the General Manager or their delegate to enter into a contract with DG Harper Pty Ltd (ABN: 47 000 762 596) for the Removal and Disposal of Underground Petroleum Storage Tanks, Supply and Installation of Above-Ground Refuelling Facility for their lump sum amount of $490,453.27 excluding GST

c       authorise the affixing of Council’s Common Seal to all relevant documents as required

Councillor R Kendall declared a Significant Non-Pecuniary Interest and vacated the chamber, the time being 8:23pm.

20/457       RESOLVED:

                   On the Motion of Councillors D Hayes and K Pascoe

That Council:

a       extend the lease for 99 Peter Street, Wagga Wagga with the Leisure Company Disability Service Ltd on a month by month basis, with a minimum two months’ termination notice period

b       delegate authority to the General Manager or their delegate to execute any necessary documents on behalf of Council

c       authorise the affixing of Council’s common seal to all relevant documents as required
