RP-4        RIVERINA WATER COUNTY COUNCIL - APPOINTMENT OF COUNCILLOR

That Council:

a       receive and note Councillor Paul Funnell’s resignation from Council and Riverina Water County Council

b      conduct an election of one Councillor to the board of Riverina Water County Council as a replacement for Councillor P Funnell

c      note that in accordance with the Local Government (General) Regulations 2005, the General Manager is the Returning Officer for the election of a member to Riverina Water County Council

d      note that in the event of there being more than one candidate for the Riverina Water County Council, an election will be held in accordance with Clause 396 (Schedule 9) of the Local Government (General) Regulation 2005, and that such election is to be determined by preferential ballot

ELECTION OF MEMBERS TO RIVERINA WATER COUNTY COUNCIL

 

At this stage of the meeting, Director Community Services, Mrs Janice Summerhayes, advised the meeting that she had been appointed by the General Manager, Mr P Thompson as the Returning Officer for the election of a Councillor to the Board of Riverina Water County Council and that Manager Governance and Risk, Ms Ingrid Hensley and Corporate Governance Coordinator, Mrs Nicole Johnson accepted the invitation as scrutineers in the conduct of the election.

 

The nominations received for the Board member of Riverina Water County Council were:

·       Councillor Dan Hayes

·       Councillor Dallas Tout

 

The Returning Officer, conducted the election. Ballot papers were distributed in accordance with Schedule 7 Part 1 (1) of the Local Government (General) Regulation 2005 for the election of one board member of Riverina Water County Council.

 

Following receipt of the completed ballot papers, the following votes were recorded:

 

·       Councillor Dan Hayes - four (4) votes

·       Councillor Dallas Tout - four (4) votes

 

 

The two (2) Councillors names were put into the ballot box and drawn by the Returning Officer, Mrs Janice Summerhayes with Councillor D Tout being drawn out and therefore eliminated.

 

With only one candidate remaining, Councillor Dan Hayes was  elected to the position of Board member of Riverina Water County Council from 9 August 2021 until 3 December 2021.

 

 

RP-5        COUNCIL MEETING DATES - 2021 - 2022

 

A Motion was moved by Councillors D Hayes and V Keenan

 

That Council endorse the schedule of Ordinary Council meetings for the period September 2021 to December 2021 as outlined in the report with an addition of an Ordinary Council Meeting on Monday, 17 January 2022.

 

An AMENDMENT was moved by Councillor R Kendall and seconded by Councillor K Pascoe

 

That Council endorse the schedule of Ordinary Council meetings for the period September 2021 to December 2022 as outlined noting 2022 Council Meeting Dates are subject to consideration by the newly elected Council.

 

The Mayor, Councillor G Conkey OAM declared the original motion out of order  in accordance with Council’s Code of Meeting Practice Section 10.6, in that the original Motion was unlawful and would breach Section 290 1(a), Local Government Act 1993, that states the election of the mayor by the councillors is to be held, if it is the first election after an ordinary election of councillors, within three weeks after the ordinary election. With this ruling the amendment became the Motion.

 

An AMENDMENT was moved by Councillors D Hayes and V Keenan

 

That Council endorse the schedule of Ordinary Council meetings for the period September 2021 to December 2021 as outlined in the report with an addition of an Ordinary Council Meeting to be held on Monday, 10 January 2022.

 

The AMENDMENT on being put to the meeting CARREID and became the Motion.

QUESTIONS/BUSINESS WITH NOTICE

 

Councillor K Pascoe requested Council consider whether the Tarcutta Progress Association can undertake the BBQ Maintenance & Cleaning Works for remuneration.

Councillor D Hayes requested an update on improving the pedestrian crossing at the Fernleigh Road rail crossing.

 

Councillor V Keenan requested Council investigate installing additional bus stops in the Lloyd area, particularly in the newly developed section.

 

Councillor R Kendall requested that the General Manager thank staff for their efforts to maintain roads and Council infrastructure given the recent rain events.

 

Councillor T Koschel requested advice regarding requirements for Mayoral and Deputy Mayoral Elections given the postponed election.

 

The Mayor, Councillor G Conkey OAM advised that in accordance with advice from the Office of Local Government, the Mayor will continue to hold office until council elections are held on 4 December 2021, given the provision that Council elected its Mayor in September 2020. In relation to the position of Deputy Mayor, further discussions will be held between Council and the General Manager at an upcoming workshop.
