Summary:

Develop a working group of interested representatives and identifying the current challenges as well as identify opportunities to increase night time activity and economy.

 

 

Recommendation

That Council receives a report about developing a night time activity and economy working group to focus on the specific barriers to overcome and opportunities to increase and develop Wagga’s night time activity and economy.

 

Report

Increased night time activity and economy can bring valuable economic, social, and cultural life to Wagga. Night time economies are often discussed in terms of capital cities but there are opportunities for Wagga to also improve the activities for residents and businesses in the late afternoons and evenings throughout the week and weekends. By developing a working group of interested representatives and identifying the current challenges as well as identify opportunities, it will enable a thorough plan to be created to potentially increase activity after hours in Wagga.

Currently the night time economy for our city is predominantly pubs, restaurants, and occasional events. While these are an important aspect of any city there are other opportunities to broaden this scope for a wider variety of community members.

Some of the issues this working party could focus on include:

-   Planning laws

-   Business hours

-   Late night shopping

-   Uses for public spaces

-   Infrastructure needs both large and small

-   Transport

-   Safety

-   Liquor licensing rules

It is important that the working group does not drift into becoming an events planning group. While events are one aspect of a good night time economy, the pull to focus on events or planned entertainment can be strong and often can overshadow other opportunities that may result in better long term and permanent changes. The focus on events can also lead to relying on significant levels of funding. For example, it may be better to look at improved lighting and seating in public places then to spend time organising a one off event.

Wagga should also recognise that the needs differ amongst and within age groups and that night time activities and economy are not just for one select group. For Wagga it may mean looking at the after school hours of 3pm-6pm for high school students, as well as creating opportunities for older people, theatre goers, visitors for business or recreation, as well as others.

Catering for different ages is one facet but there is also the fact that the CBD is quite long which creates an opportunity at improving different sections to meet different needs. For example, the creation of an arts precinct connecting the conservatorium, the Ambo, Visual Dreaming, the art and glass galleries, museum, civic theatre, and playhouse provides unique opportunities for that area, while it may be different for the end of Baylis St. Another example is that parking is uniformed along the whole main street yet there may be better options depending on what services, businesses, and uses predominantly occur in that particular block.

Improving Wagga’s night time activity and economy has been talked about over a number of years but it has been done sporadically and in a piecemeal approach. Discussions over many years reveal that there is a general consensus that it should be improved but it needs a dedicated focus. This working party has the potential to create that focus and set Wagga up for years to come.

NOM-2           NOTICE OF MOTION - REDUCING GREENHOUSE EMISSIONS FROM GAS

Summary:

Wagga Wagga City Council’s commitment and work towards addressing climate change and focusing on environmental sustainability.

 

 

Recommendation

That Council:

a       notes Wagga Wagga Council’s commitment and work towards addressing climate change and focusing on environmental sustainability, including but not limited to an aspirational target to achieve net zero carbon emissions for the Wagga Wagga Local Government Area (LGA) by 2050, establishment of a green power purchase agreement, solar panels on council assets where feasible, and other strategies as outlined in various Council reports

b       commits in principle to reducing greenhouse emissions from gas, both from Council operations and from the broader community

c        requests staff to prepare a report covering

i         a high-level audit of Council facilities that currently have gas connections and identifying opportunities for conversion to electric

ii        the feasibility of formalising a change to Council policy whereby existing gas connections and facilities in Council-owned facilities are replaced with electric equivalents, on the next occasion they are significantly upgraded/renovated

d       a recommendation to Council regarding how changes could be made to the most recent versions of the Wagga Wagga Local Environment Plan and Development Control Plan, to reflect the phasing out of gas connections to new dwellings and in alterations and additions to existing dwellings

 

Report

Wagga Wagga City Council has adopted an aspirational target of Net Zero emissions by 2030. Gas is a fossil fuel and must be phased out if the world is to achieve its target of net zero emissions.

 

It is now widely accepted that the cheapest and easiest pathway to decarbonisation is through electrifying everything: because electricity from renewable sources is cheap and easily accessible.

 

Methane (the key component of LNG) is up to 83 times more polluting in a 20-year period than carbon dioxide and fugitive emissions are routinely under-reported (IEA 2022).

 

The International Energy Agency has advised that no new gas fields can be developed if the world is to achieve net zero emissions safely and sustainably by 2050 (IEA 2021).

 

Gas burned in the home releases a cocktail of airborne pollutants including nitrogen dioxide, carbon monoxide, formaldehyde and particulate matter with a range of health consequences, particularly for the young, old and frail. Similar in impact to living with a cigarette smoker in the home, having gas appliances in a household increases the chances of childhood asthma by at least 12%. The risks to human health of gas appliances in buildings is particularly felt by lower income residents who are more likely to live in smaller, more populated households and lack the resources to adequately maintain their appliances to reduce these risks (Climate Council 2020).

 

Gas is increasingly uneconomical with the market price in NSW (AER 2022) roughly doubling in the 12 months from December 2020. As more people turn away from gas and towards renewable energy and increased energy efficiency measures the price of gas will rise as the remaining gas users carry the burden of pipeline infrastructure which the Australian Energy Regulator has identified as stranded assets. Households with an existing connection wishing to disconnect from gas face a disconnection charge. 

 

Gas is an increasingly insecure energy source. The hunt for more gas to supply the domestic and import markets creates market volatility and carries environmental risk which can be avoided through renewable electrification.

 

Gas connection refusals are increasing across the state, nationally and internationally. In 2019 the City of Berkeley in California was the first US local government to refuse new gas connections, by unanimous approval, across their municipal areas. In 2021 the ACT Government announced a ban on new gas connections in developing suburbs and the City of Canterbury Bankstown have already proposed a denial of gas connections in key growth areas. A rapidly growing number of councils are replacing gas in council buildings in favour of renewably powered electric appliances to manage municipal carbon emissions and costs.

 

The best way to safeguard the economic and health interests of Wagga Wagga LGA residents, and to reduce climate impacts, is to not connect gas to households and other buildings in the first place.

Summary:

The report is for a development application and is presented to Council for determination. The application has been referred to Council under Section 1.10 of the Wagga Wagga Development Control Plan 2010 (DCP) as the application received more than 10 submissions.

 

The details of the submissions are contained within the attached Section 4.15 Assessment Report.

 

 

Recommendation

That Council approve DA22/0460 for Two Storey Childcare Centre (46 Places), demolition of existing structures, carparking area and fencing at 32 Halloran Street, Turvey Park NSW 2650 (Lot 29 Section B DP3733) subject to the conditions outlined in the Section 4.15 Assessment Report.

Site Location

 

 

The subject site is legally identified as Lot 29 Section B, DP3733 located at 32 Halloran Street, Turvey Park. The site is located on the western side of Halloran Street, approximately 24 metres from the intersection of Halloran and Blamey Streets. The site is rectangular in shape and comprises of 1018m² in area. The site currently contains two existing dwellings and various outbuildings.

 

The surrounding locality is characterised as an established residential area. Built form is reflective of the boom in development and growth of the city after World War II with post war dwellings lining the western side of Halloran Street. The eastern side of Halloran Street contains Turvey Park Primary School.

·     The proposed development seeks consent for a Centre Based Child Care Facility (46 places). The development will comprise of:

o Demolition of the existing structures within the site;

o Construction of a two storey Child Care Facility that will care for children aged from 0 to 5 years in 4 separate rooms with a kitchen, laundry, reception area, office, meeting rooms, staff room and child and staff facilities;

o Outdoor play areas;

o Storage shed; and

o Carparking, vehicle movement area and landscaping.

The Centre will operate from 7am to 6pm Monday to Friday. Staff will be present on site from 6:30am to 6:30 pm each day. The centre will employ a total of 12 staff.

·    The site is zoned R1 General Residential under the provisions of the WWLEP2010 and centre based childcare facilities are permitted with consent in the zone.

·    The development generally complies with the provisions of the State Environmental Planning Policy (Transport and Infrastructure) 2021, WWLEP2010 and the WWDCP2010.

·    Forty-eight submissions were received during the notification period. The submissions raised concerns in regard to traffic, impacts of two storey development on the streetscape, amenity and character of the locality, noise, children’s safety, inconsistency with the LEP, DCP and the Child Care Planning Guideline, suitability of the subject site and the public interest. The submissions are addressed in detail in the attached s4.15 report.

 

Having regard for the information contained in the attached Section 4.15 assessment report, it is considered that the development is acceptable for the following reasons and recommended for approval.

 

Reasons for Approval

1.    The proposed development is consistent with the provisions of the Wagga Wagga Local Environmental Plan 2010;

2.    The proposed development satisfies the requirements in regard to State Environmental Planning Policy (Transport and Infrastructure) 2021;

3.    The applicable objectives of Sections 2 and 12 of the DCP are satisfied by the proposed development; and

4.    For the abovementioned reasons it is considered to be in the public interest to approve this development application.

Council resolved on 18 July 2022 for the General Manager or delegate to enter into a Lease with Airborne Gymnastics Pty Ltd in its capacity as Trustee of the Appleton-Seymour Family Trust for occupation of the indoor recreation facility at Bolton Park for a period of five years with an option for a further five years (Resolution 22/221).

 

Council staff have, on review, noted that the ACN number referenced in the Council Report and Resolution are incorrect and the documentation should reference Airborne Gymnastics Pty Ltd (ACN 109 647 350) in its capacity as Trustee of the Appleton-Seymour Family Trust. An updated Council resolution is being sought to accurately reflect the entity that Council is entering into a legal agreement with.

 

 

Recommendation

That Council:

a       authorise the General Manager or delegate to enter into a Lease with Airborne Gymnastics Pty Ltd (ACN: 109 647 350) in its capacity as Trustee of the Appleton-Seymour Family Trust for occupation of the indoor recreation facility at Bolton Park for a period of five years with an option for a further five years

b       authorise the General Manager or delegate to complete and execute any necessary documents on behalf of Council

c        authorise the affixing of Council’s common seal to any relevant documents as required

It is therefore recommended that Council authorise the General Manager or delegate to enter into a Lease with Airborne Gymnastics Pty Ltd (ACN: 109 647 350) in its capacity as Trustee of the Appleton-Seymour Family Trust.

 

Financial Implications

As this recommendation relates to adjustment of the entity referred to in a previous resolution only, there are no additional financial implications if resolved as recommended.

RP-3               SUB-LEASE AGREEMENT - LIGHT AIRCRAFT PRECINCT HANGER 20, WAGGA WAGGA AIRPORT, FOREST HILL - CHANGE OF SUB-LEASING ENTITY

Summary:

Council has resolved for the General Manager or delegate to negotiate entry into a Sub-Lease Agreement with Intellifleet Pty Ltd ABN 22 135 938 573 (Resolution 21/048). The proposed tenant has now advised Council that they wish to nominate a different corporate entity to enter into the sub-lease.  Accordingly, a Council resolution is sought endorsing the entry of a Sub-Lease Agreement with the new entity.

 

 

Recommendation

That Council:

a       authorise the General Manager or delegate to enter into a sub-lease agreement with Gwet Pty Ltd (ACN: 085 546 158) for Hanger 20 within the Light Aircraft Precinct at the Wagga Wagga Airport, Forest Hill

b       authorise the General Manager or their delegate to complete and execute any necessary documents on behalf of Council

c        authorise the affixing of Council’s common seal to any relevant documents as required

 

Report

Council resolved on 22 February 2021 (Resolution 21/048) to “consent to the assignment of the sub-lease between Wagga Wagga City Council and Intellifleet Pty Ltd for Hangar site 20.”

 

Council have instructed its solicitors to prepare a sub-lease agreement for the site, and the draft sub-lease has been provided to Brett Fellows for review. Following review, Mr Fellows has advised Council that he wishes to have another company nominated as the sub-lessee under the agreement. 

 

The proposed new sub-leasing entity, Gwet Pty Ltd (ACN: 085 546 158), is a registered company with the Australian Securities & Investments Commission (ASIC). The Directors of the proposed sub-lessee are Brett Anthony Fellows and Gwendolen Jane Fellows, and the Secretary is Gwendolen Jane Fellows. The shareholders in the arrangement are Brett Anthony Fellows as to one B-Class Share, and Gwendolen Jane Fellows as to 1 A-Class Share, and 1 Ordinary Share.

 

It is noted that the registered Directors / Shareholders of Gwet Pty Ltd (ACN: 085 546 158) are the same as the existing proponent Intellifleet Pty Ltd (ACN: 135 938 573), it is recommended that Council authorise the General Manager or delegate to enter into a sub-lease agreement with Gwet Pty Ltd in lieu of the original proposed tenant, Intellifleet Pty Ltd.

 


 

As Wagga Wagga City Council lease the airport from the Commonwealth of Australia, final execution of the sub-lease agreement would also be conditional upon Council obtaining consent from the Commonwealth of Australia to entering the final sub-lease agreement.

Financial Implications

As the proposed resolution relates only to an adjustment to the legal entity with whom Council intends to enter into a sub-lease, there are no financial implications associated with this resolution.

Failure to endorse the proposed legal entity may lead to the proposed tenant being unable to enter into a formal sub-lease agreement with Council. This may create financial implications for Council as anticipated revenue will not be collected and Council would need to find an alternative lessee for the site.

 

It is noted that based on the previous resolution of Council, the proponent has undertaken work including lodgement of development application. If Council did not proceed as recommended, Council could potentially be exposed to a claim for compensation by the proponent.

Councillor D Hayes requested an update on replacing the disconnected footpath along Johnston Street near the levee bank (Clr23/0062)

A request has been submitted to the responsible crew asking for these works to be scheduled as soon as possible.

 

Council contributes to fund the local NSW Fire and Rescue service in Wagga. For approximately 8 of the last 12 months the truck with the aerial pump has been out of service only returning recently. Councillor D Hayes has requested if the contribution council pays includes paying for an aerial pump that was not in service for most of the year or was a reduction provided by the State Government? (Clr23/0053)

Staff are still waiting for a response from NSW Fire and Rescue. A response to the Question with Notice will be provided once this is received.

 

Councillors D Hayes and R Kendall requested advice on the repair of Edmondson Street Bridge (Clr23/0068)

A Councillor workshop is being scheduled to discuss the status and way forward, with a report to be presented to Council following this workshop.

The Local Traffic Committee met for an ordinary meeting on 23 March 2023 and considered 6 formal reports.

The Committee were unanimous with the officer recommendation to Council for each of the 6 formal reports presented.

Report

The Traffic Committee met on 23 March 2023 and considered 6 reports.  A summary of each report is as follows:

 

RP-1     Sydney Street Tarcutta - NO PARKING

This recommendation is in response to a customer request by the licensee of the Tarcutta Hotel to restrict the overnight parking of heavy vehicles directly in front of the hotel.

There are currently no parking restrictions for any vehicle type on this section of the Old Hume Highway and during the evening and early morning, the area is predominantly used for parking by semi-trailers and B-Doubles.

The customer advises that drivers are regularly conducting operations such as trailer changeovers and vehicles with refrigeration units left running for long periods, impacting on the amenity of the hotel, particularly the accommodation and external dining area during the evening and overnight.

RP-2     ACTIVE TRAVEL PLAN - FOREST HILL LINK

The plan for a section of the Active Travel Project Forest Hill Link has been issued for construction and required Traffic Committee approval in respect of the proposed traffic control devices prior to construction in 2023.

 

Staff sought support from the Committee for a speed zone review by Transport for NSW on Mitchell Road, north of the intersection with Kyeamba Avenue, from 80 km/h to 50 km/h. The proposed 50 km/h speed limit better suits the semi-urban residential environment of the roads and will provide a safer road environment for pedestrians and cyclists to cross Mitchell Road and Tamarind Place.

 

RP-3     College Avenue and Charleville Road - Roundabout signage and linemarking

The construction of a new roundabout at the intersection of College Avenue and Charleville Road as part of DA19/0001 has been completed and the recommendation was considered at the traffic committee meeting in December 2022, with the committee deferring the recommendation pending advice regarding the swept path capability of a bus.

 

The requested information has been provided by the developer and was considered by the Committee. The additional information regarding heavy vehicle turning movements resulted in recommendation (e) being supported by the committee.

 

RP-4     JOHNSTON STREET - SHARED WOMBAT CROSSING

The Wagga Wagga Local Traffic Committee, in their meeting on 27 July 2022, resolved to remove the existing pedestrian ‘Zebra’ crossing on Johnston Street and approve the installation of two accessible parking spaces on the Southern kerb of Johnston Street.

 

The Committee requested that alternate pedestrian crossing solutions be explored, which would enable pedestrians approaching from the northern side of Johnston Street to access the Riverside Precinct through a pedestrian priority crossing facility. 

 

Investigations support a proposal for a Shared Wombat Crossing on Johnston Street in the same location as the existing pedestrian ‘Zebra’ crossing, which meets relevant Australian Standards and Transport for NSW design guidance related to shared path facilities.

 

RP-5     ACTIVE TRAVEL PLAN - MORGAN STREET LINK

The ATP Project Team has developed a plan to improve the safety of access at the entrance to the Oasis Aquatic Centre and adjacent carpark as part of the Active Travel Plan – Morgan Street Link. The proposed changes outlined in C2158 will address the following matters, identified by Council staff through community consultation:

 

1.    Installation of traffic control facilities including chicanes, enhanced delineation and signage, to reduce the risk of collision between ATP users and people exiting the Oasis facility.

2.    Replacement of uneven pavers outside the Oasis with concrete infill.

3.    Re-bedding of pavers to the East of the Workout gymnasium; a noted thoroughfare for people who use the accessible parks within the large off-street carpark to the East of the Oasis.

 

These improvements will provide a continuous shared path connection between the ATP network and the Oasis end-of-trip facilities and have been designed in accordance with AS1742 and the Transport for NSW Cycleway Design Toolbox.

 

RP-6     BAKERS LANE RECONSTRUCTION

Council is in the process of developing construction plans based on the attached Concept Plans that involve downsizing the existing landscaped median island to a paved traffic island and subsequent re-alignment of the Northbound Lane.

 

All the regulatory signs on the concept plan currently exist with the exception of the ‘Give Way’ sign on the left hand side of the northbound lane.  Council is therefore seeking the concurrence of the committee to install this additional sign as well as the line marking as shown before finalising the ‘Issued for Construction’ plans.
